TIMESHARE POINTS MANAGEMENT CONTRACT
CONTRACT, made this ____ day of __________, 2008 between Vacation Villa Rentals, (hereinafter the “We/Us”), a family operated service having our principal place of service at 4547 Chestnut Ridge Road, Amherst, NY 14228, and _______________, (hereinafter “You/Your”), residing at ____________________________.
WHEREAS, You desire Us to secure timeshare units on Your behalf and to best utilize the total number of Wyndham/Fairfield points assigned to You. You and We agree as follows:
Terms and Conditions:
No request is guaranteed, although, We are a family operated service and We, ourselves own over 9,000,000 points with Wyndham/Fairfield. We, ourselves travel 6 months out of the year in timeshare units and Our own success rate for confirming one and two bedroom, “Gold Crown” and “Five Star” villas is 97%. We, therefore, offer to You a high rate of success in managing and securing the villa(s) You want at the time You want it (them).
Although, not necessary, We suggest three different weekly dates and three different, but like resorts, for each weekly request. We will confirm partial week requests of two to six nights, as well as weekly requests.
We will only accept points that have at least six months of usage available for the year in which points are managed for You to receive full benefit of 20% maintenance reimbursement.
We will accept points one to two years in advance of the year that management is requested.
We will, at Our discretion, accept points that have less than six months of usage, but they will not entitle You to the 20% reimbursement of Your yearly maintenance fees of points managed, but will entitle You to Our best efforts in confirming what You request.
You cannot secure more units than Your points will allow. All units confirmed will have points deducted from Your account, according to the size of unit and season that Wyndham/Fairfield lists in it’s current yearly directory of resorts, i.e. Bonnett Creek, two bedroom, prime season, will deduct 224,000 points, presently, from Your account.
We will, at Our own discretion, decide whether or not to accept management of Your account.
We require a copy of each point’s contract, maintenance fee billing, to determine 20% of Your total maintenance cost per year, for the amount of points managed on Your behalf.
We require Your membership account number(s) to verify Your total number of points to be managed, on Your behalf.
We will give our best effort in confirming RCI and II units, on Your behalf, as well as Wyndham/Fairfield units. Our goal is to secure a “Gold Crown” or “Five Star” villa for You.
We require that all maintenance fees be paid by You, when due, on time, otherwise the 20% reimbursement of Your maintenance fees will be denied. In such case, as fees are not paid on time, by You, We will, still, try to confirm units requested, but only until and up to the point that Your management company allows. If point usage is not allowed by Your management company because of non-payment of maintenance fees or any other reason, then Your request for any unit will be denied. In the event that Your management company requests Your points be withdrawn from Our account, for any reason, then We will be forced to give them up, but not until We make sufficient effort to contact You first.
All points managed are to be transferred into one of Our accounts ending in 7390, 9299, or 2021.
The 20% reimbursement of Your maintenance fees will be paid within 90 days of the close of Your use year for points managed according to these Terms and Conditions.
Wyndham/Fairfield will not allow cancelled, credit pool, or PI (points to be transferred), so We cannot accept them in full retrospect of these above stated Terms and Conditions. Although, We can help You to manage those points by having full access to Your personal account(s) with full account number(s). This waives the 20% reimbursement of Your maintenance fees, but it will allow Us to confirm what You need. We will only accept management of such points if We already have a regular management account set up with You.
